Ecuador Accepts Citizen-Led Cannabis Reform Initiative

National cannabis prohibition policies spread across the globe many decades ago, and while it took a very long time for the first nation to finally adopt a national adult-use cannabis legalization measure, the momentum for freedom has continued to build ever since.

Uruguay was the first country to modernize its national adult-use cannabis laws, with the country’s lawmakers approving a historic legalization measure in 2013. Uruguay was followed by Canada in 2018, Malta in 2021, Luxembourg in 2023, both Germany and South Africa in 2024, and Czechia this year. If cannabis advocates in Ecuador have their way, their country will join that list.

“Ecuador’s National Assembly has accepted a citizen-led initiative to regulate the responsible use of cannabis. While this does not yet imply immediate legalization, it does open a fundamental debate in a country where the discussion on drugs is beginning to move beyond the punitive framework and into the political arena.” reported Cañamo this week.

“What happened in Quito carries political weight that extends beyond the parliamentary session, as the legislative proposal was presented as a citizens’ initiative and overcame the first formal hurdle, since the Assembly deemed it compliant with the technical and legal requirements to move forward. This is important because it shifts the discussion from the realm of prohibition to the actual legislative process, with defined deadlines and institutional actors. It also reopens a conversation that had already begun in Ecuador regarding medicinal cannabis, albeit within a more limited framework.” the outlet added.

Cannabis activists in Ecuador, affiliated with the Network of Cannabis Organizations and Individuals of Ecuador (REDCAN), launched the initiative effort in 2023 and started the process of gathering the necessary number of signatures to force consideration of a cannabis regulation measure. REDCAN submitted the first batch of signatures to Ecuador’s National Assembly in the fall of last year.

The initiative aims to place cannabis under government control, to allow adults to obtain a medical prescription, to tax the prescriptions, and to invest the generated revenue in education and prevention. The proposal also seeks to create a national institute for cannabis regulation.

Ecuador has a checkered past when it comes to cannabis policy. Like many of its continental peers, Ecuador has experienced a significant amount of violent cartel activity over the years. Geographically positioned between Peru and Colombia, two of the largest cocaine producing countries, Ecuador’s cannabis policies have historically been driven by a ‘war on drugs’ mentality among its leaders.

For a long time, Ecuador’s cannabis policies did not differentiate between personal cannabis activity and large-scale trafficking activity. Both sets of cannabis activity resulted in harsh penalties for people caught by authorities.

In 2013, Ecuador’s National Assembly passed a new criminal code, which went into effect in 2014. The new criminal code effectively decriminalized the personal possession of up to 10 grams of cannabis. Unfortunately, the public policy change would later be repealed.
